You assume this only applies to race. Show me where it says anything about race in this part of the amendment...? It says ANY PERSON.
You just proved it right there. See it says ANY PERSON. It does not say "any person or gay". So why do you think gays are included?
Please tell me you're being sarcastic.

| What I can't figure out to this day is what impetus there is for people to go to such great lengths to deny giving something that has no deleterious effects. Letting gays marry affects no one but gay people. It doesn't tarnish the marriages of others any more than a Jewish or atheist or Wiccan wedding tarnishes the marriages of Christians and Muslims. |

Yes, "equal protection under the law" has nothing to do with anything legal.

As such - why would allowing gay marriages be a "good thing"?
Because following the Constitution is a "good thing", and because discrimination is a "bad thing".
Who's following the Constitution??? Where in the federal constitution does it say that the federal government has the power to define what marriage is, to recognize only those who are "married" under it's definition and then to give only those it recognizes as "married" all kinds of preferential tax and legal treatment?
NOWHERE!
Fact is, marriage law is beyond the scope of the enumerate powers of the federal government. In other words, IT'S ILLEGAL! That's probably why most Republicans pushed so hard to urge the passing of the Federal Marriage Amendment Act as soon as the subject of gay marriage came into the spotlight. They were worried, and still are, that the debate over gay marriage will eventually lead to a debate over the issue of federal marriage policy in general and the possible abolishment of all federal marriage policy by the Supreme Court- which I hope it does, soon.
The other fact is, most of the support for federal marriage policy comes from the Christian mainstream. Some of whom clearly don't mind subverting Constitutional law in favor of "God's word" and others who don't mind ignoring the illegality and inherent unfairness of federal marriage policy to take advantage of all the wonderful benefits it provides. |
