1) Were other kids involved? If so, then the sexual abuse of children charge should stand, if not, it doesnt' make sense.

2) Child pornography is defined as sexual images of actual people under the age of 18 involved in sexual activities. She did possess and disseminate child pornography. The real question is whether she should be charged as an adult. Without a doubt, pictures of her having sex are child pornography, no matter her willingness or even her own production of the photos.

Well, if she's the only one involved I agree, it's not a proper charge. However, it doesn't specify if those sex acts were of herself by herself or with others. If they involve others under 18, she is involved in the sexual abuse of children. Also, if she sent them to people under 18, I could see the charge as well.

Maybe the government should just not get involved with this. This kid just needs more supervision, and a grounding. Where are her parents?

I think instead of wasting time taking her to court and sending her to a correctional facility, they should just put a pic of her on TV and in the newspaper saying if you have this girl's photos/videos on your HD delete them as she is under age and basically let her go and allow the people who have the pics/vids to delete them. No harm done. Plus I think the humilation of having her face plastered all over TV/newspaper will deter her from doing it again as well as any other would be exhibitionists.

I do not think so, or they would have mentioned it I think. That isn't a small detail. If her friend under 18 was also involved, it still doesn't make sense. It would be like, a 16 year old guy and a 16 year old girl having sex. It isn't considered statatory rape because they are both under 18. The idea behind the law to prevent older people from taking advantage of younger. That wouldn't apply here.

Wow. That makes sense. Charged as an adult for being a kid and taking pictures of yourself.

I wasn't trying to mock you, I know what you meant, that that would be ridiculously prosecutory and a hell of a stretch to make that much of a glaring contradiction just to rob someone of freedom.

Why can’t the goddamn justice system just be able to realize when someone is not being harmed, and really, there is not need for punishment. It’s not that hard. Good point. When the f**k did government take the parent's job. It is the parents job to set cerfews and what children can and cannot do.

It's her body, it's her right to post crap on the internet, it's right responsibility when she gets raped like those girls over myspace, then it's the police's responsibility to catch the rapist, then it's our responsibility to pay for him to sit in jail for the rest of his life.
