The fact that America has tried to get around it by the use of the term enemy combatants shows that America still does not wish to be seen breaking the law. However holding people with out trial is not just breaking international law it is breaking American Constitutional Law.
The Supreme Court has made a number of rulings regarding Guantanamo, including the fact that military tribunals are not constitutional, that those held at Camp X-Ray have a right to challenge their detention through the US Courts and that cruel and usual punishments are unconsitutional.
Never mind international laws - you are breaking the laws at the very heart of the American Constitution.
Ardent, the U.S. Constitution only applies to U.S. Citizens. Any rights granted, including due process are granted to such citizens only.
Anyway, I never said anything about whether that point was right or wrong. I was just talking about the theory we call international law.
Well, you're wrong here. The Constitution grants NO rights, it protects them. However, military law and civil law are separate. Personally, though I think we should send every Gitmo prisoner to Afghanistan, to stand trial there. We should send the Chinese prisoners at Gitmo back to China, as they have been cleared. |

Nature?
Nature is red with tooth and claw. Lion eats the lamb.
Our country is based on the premise that rights come from our Creator, not from government. To deny that is to deny the legitimacy of our country. |
