i have a question,
if i use a video capture card, capture a TV show, edit out the commercials for my own personal use then its fine?
what about sharing it with others, both digitally, and by handing copies to friends, it was taped off a public channel, obviously it doesnt become public domain, but can the company really expect 100% control of their programming when they broadcast it?
anybody have a clue? |

Personal use = legal.
Public showing and giving copies away = illegal.
They can't control it because so many people do it, but if you're caught they will prosecute you as much as possible. |

Your'e right they don't have any control.
If your just giving it to friends, don't worry about it but , if you sell it and you're caught, you will be prosecuted. |

| selling it never crossed my mind, my comp is slow so it is low quality, not worth paying for, trading fodder maybe, you know, ill get you a copy of this if you get me one of that, but never sale |

Now you're into the shady area.You're basically doing it for a gain of some kind, probably a wash as far as value but it can still be an infringement of copyright laws |

Personal use is completely legal...otherwise Tivos would be outlawed in a second.
However, as soon as you share that with somebody else to watch at their convinience while retaining a copy for yourself, that's against copyright laws. If you were to give him/her the file and not retain a copy for yourself and not expect anything in return (be it monetary or barter), then you would be within the law. |
