A pregnant woman can donate an organ to her dying Godchild. Without it the Godchild is certain to die. With it the child has good chance at life. But in doing so, the risks to her pregnancy are considered significant. The result is likely to be miscarriage. She is 4 months pregnant.
Who has the right to decide what she does and why? Should it be illegal for her to put the pregnancy at risk with the procedure? Should she be considered a criminal if the pregnancy is lost? If she does the procedure and loses the pregnancy has she committed negligent homicide? Murder? Or should the decision be hers and why?
(note: the above facts aren't in dispute - don't bring semantics and spin into this thread. The purpose is to discuss what if anything she should be able to do and why). |

Good questin. She wouldnt be liable, a doctor would. We would first have to assume that abortionis illegal. This situation you made up was great and it is something lawyers would battle over before a new law was made.
A lawyer could argue that by removing the organ, he knew the baby would die, and even though it was her choice, the doctor had an obligation to his other patient (the baby). After all, if abortion is illegal, that means the courts have given the unborn fetus as much of a say over its mother's body as the mother has. Thus, if the doctor grossly endangers one patient without its consent (a fetus cant consent) , the doctor would be violating her oath. |

Anyways, I cant think of any type of organ donation that would give any likelihood of causing the fetus to die.. I mean, even pregnant women only need one kidney, then theres the gallbladder, and the appendix...
What kind of organ donation (hypothetically) are you even discussing?????? This just isnt plausible. Sorry. |

First of all, because abortion is legal, this conversation has ZERO bearing. If abortion is illegal, then the courts would recognize the fetus as an entity with rights, right to life being one of them.
Sailor, I dont understand your logic. I can gaurantee you, with legal certaininty, a doctor would be prosecuted for this. Would he be acquitted, I don know, but he would be prosecuted.
Think about this LEGALLY, as if you were a member of the court. A doctor would be performing gross negligence under the current statute if the fetus had a right to life. |
