Hello, I'm from England and am very curious about how the US Constitution claims it adheres to popular sovereignty. Do you believe this is true in your legislature and judiciary?
THanks for any of your opinions! |

alright curious I was ready to lie right to you and say that my country is grand and taught me all about sovereignty but frankly I didn't know how to
spell it. So I looked it up and I was quite suprised I didn't know that the
constitution provided soveriegnty. Let alone that it adhered to it.. so why do
you ask? |

Yes and no, Curious.
Popular Sovereignty is important to our government. It's supposed to be, anyway. We can't decide what our representatives do once they get to D.C., but we ARE the ones who get them there. Whether or not we are voting on who they really are or what they really stand for anymore or just a campaign team's altered picture, the people vote on what they are given. That's how our senators and congressmen get into office.
But Popular Sovereignty alone would destroy the rights of a minority. Our judiciary is set up to resist a popular vote. This is a safeguard against the tyranny of a majority. If 99% of the people decide that murdering th other 1% is right, that doesn't make it right. Therefore, we have the judiciary that rules on what is right whether the people think it is or not. Of course, our judiciary is made of men and not angels, so this will not always work. But I think it's a pretty good system.
Hope that helps.
And please don't give us that crap about how when the Constitution was written the framer's didn't really think everyone was equal and that it's all just to sound good. We've heard it before. We know. We don't care. |

When the government says: The people are sovereign; that means the government is sovereign, and that they are going to do as they please. |
